Abstract: The talk will review the art of preparing patent applications, including how to draft claims that will likely pass patent office scrutiny and possibly survive litigation. In addition to reviewing the various parts of a patent, we will also discuss the process of prosecuting a patent application before the U.S. Patent and Trademark Office, and the importance of a patent's prosecution history. The foreign filing process and costs associated with filing in other countries will be reviewed. The importance of patentability, non-infringement, and patent validity legal opinions will also be discussed. Finally, various aspects of patent litigation will be reviewed including the use of intrinsic and extrinsic evidence, claim construction, the effective use of experts, defenses, costs and possible alternatives to litigation.
Biography: Bill is an Intellectual Property/Patent Attorney at Caesar, Rivise, Bernstein, Cohen, & Pokotilow, Ltd. in Philadelphia. He is a graduate of Temple Law School as well as Drexel University where he earned a degree in Chemical Engineering. He has been admitted to practice as a patent attorney before the United States Patent and Trademark Office. He is a member of the Chemical Consultants Network.
