Abstract:
Companies of all sizes in technical fields as chemistry, chemical engineering, pharmaceutics and biotechnology are typically well versed in intellectual property including trade secrets, patents, and trademarks. Consultants need to be aware of intellectual property issues that may be encountered during the execution of an engagement with such client companies, not only the sake of the client vis-à-vis the client's competitors, but also to be aware of any pitfalls related to the inventorship and ownership of rights to new products invented during the engagement. Consultant's familiarity with patent law is also very helpful when seeking opportunities with law firms as experts in the area of opinion preparation or legal discovery, or as an expert witness during a litigation. This presentation will also analyze new trends in patent law, provide information on what attorneys look for in an expert witness, and if obtaining patents can help your consulting practice.

Biography: 
Dr. Peter D. Mlynek is an attorney with the Philadelphia office of Eckert Seamans Cherin & Mellot where he has spent most of his time addressing the patent needs of chemical, pharmaceutical and biotech companies. The focus of his practice has been on evaluating inventions and potential products from business and legal views, preparing and prosecuting patent applications, preparing invalidity opinions, freedom to operate opinions, infringement opinions, and pharmaceutical litigation. Before entering the patent field 10 years ago, Peter worked as a development scientist in the polyurethane industry. He has a Ph.D. in Inorganic Chemistry from University of Wisconsin-Madison, M.B.A. in Finance, Investment and Banking from UW-Madison, and J.D. from Rutgers.
